Blue TiefPunkt Terms of Use Effective Date: September 9, 2026 These Terms of Use (“Terms”) govern the use of software applications and related services provided under the Blue TiefPunkt brand by RMBAKER LLC, including, but not limited to: * SeaLog * PingEdit * ReconGPS These Terms may also apply to other Blue TiefPunkt applications that reference or link to them. By downloading, accessing, or using a Blue TiefPunkt application, you agree to these Terms. If you do not agree to these Terms, do not use the application. 1. Purpose of Blue TiefPunkt Applications Blue TiefPunkt applications are software tools designed to assist users with activities such as recordkeeping, data collection, data processing, file editing, positioning, mapping, documentation, and related technical or operational workflows. The functionality provided by each application varies. Blue TiefPunkt applications are intended to assist users and do not replace the user’s own judgment, verification, or responsibility for the underlying activity. 2. No Guarantee of Outcomes Blue TiefPunkt and RMBAKER LLC do not guarantee that use of an application will produce any particular result, approval, certification, license, credential, technical outcome, positioning accuracy, data interpretation, or other outcome. Acceptance of records, files, calculations, exports, or other application outputs by a governmental agency, regulatory authority, manufacturer, customer, employer, professional, software platform, or other third party is not guaranteed. Users are responsible for independently determining whether application outputs satisfy the requirements of their intended use. 3. User Responsibility Users are responsible for: * The accuracy and completeness of information they enter or import; * Reviewing application-generated records, calculations, interpretations, edits, positions, and exports; * Determining whether application outputs are appropriate for their intended purpose; * Complying with applicable laws, regulations, licensing requirements, professional standards, contractual obligations, and third-party rights; * Maintaining appropriate copies and backups of important information; * Maintaining and properly operating any equipment used with the application; and * Obtaining any permissions, licenses, subscriptions, or other rights necessary to use third-party equipment, data, files, software, or services. Users should verify important information before relying upon it or submitting it to another person, organization, governmental agency, or regulatory authority. 4. Location, GNSS, Mapping, and Navigation Applications that use GPS, GNSS, mapping, or other positioning technologies may be affected by factors outside the control of Blue TiefPunkt or RMBAKER LLC, including device capabilities, satellite geometry, correction services, signal obstruction, atmospheric conditions, multipath, external hardware, communications, operating-system behavior, and third-party services. Displayed accuracy, precision, quality indicators, averaged positions, or similar information do not constitute a guarantee of actual positional accuracy. Unless expressly stated otherwise, Blue TiefPunkt applications are not substitutes for legally required professional surveying services, certified survey instruments, or approved navigation equipment. Users should not rely upon a Blue TiefPunkt application as their sole means of navigation or for safety-critical positioning. 5. Sonar, Geospatial, and Processed Data Applications that read, edit, interpret, convert, display, or export sonar, mapping, geospatial, or other technical data provide tools for user-directed data processing. Processed, edited, interpreted, or exported data may differ from the original source data. Users are responsible for reviewing modifications and determining whether resulting data and files are technically appropriate for their intended purpose before relying upon, distributing, or submitting them. Blue TiefPunkt and RMBAKER LLC do not guarantee compatibility with every file, file version, device, software version, data source, or third-party system. 6. Third-Party Products, Services, and Compatibility Blue TiefPunkt applications may be designed to work with, process data originating from, or provide interoperability with third-party hardware, software, services, technologies, or file formats. References to third-party companies, brands, products, trademarks, or services are made for identification, compatibility, interoperability, or descriptive purposes. Unless expressly stated otherwise, such references do not indicate affiliation, sponsorship, endorsement, certification, partnership, or approval by the referenced third party. Third-party products and services are subject to their own terms, licenses, privacy policies, technical requirements, and availability. Blue TiefPunkt and RMBAKER LLC are not responsible for changes made by third parties that affect compatibility or application functionality. 7. User Data and Files Users retain responsibility for the data and files they create, enter, import, process, edit, export, or otherwise use with Blue TiefPunkt applications. Users represent that they have the rights and permissions necessary to use data or files they provide to an application. Users are responsible for maintaining backups of information they consider important. Blue TiefPunkt and RMBAKER LLC cannot guarantee against data loss, corruption, accidental deletion, device failure, operating-system failure, file incompatibility, or loss resulting from third-party products or services. Handling of personal information by Blue TiefPunkt applications is described in the Blue TiefPunkt Privacy Policy. 8. Acceptable Use Users must use Blue TiefPunkt applications lawfully and responsibly and in accordance with the Blue TiefPunkt Acceptable Use Policy. Users may not intentionally misuse an application, circumvent its security or licensing mechanisms, interfere with its operation, or use it to knowingly create or represent false or misleading records or data. 9. Purchases and Subscriptions Certain Blue TiefPunkt applications or features may require a purchase or subscription. Where purchases or subscriptions are made through an app store or other third-party platform, billing, renewal, cancellation, refunds, and payment processing may also be governed by the terms and policies of that platform. Features associated with a paid product or subscription may require verification of the applicable purchase or subscription entitlement. Prices, available features, and subscription offerings may change as permitted by applicable law and platform requirements. 10. Intellectual Property Blue TiefPunkt applications, including their original software, interfaces, designs, graphics, documentation, trademarks, branding, and other original content, are owned by RMBAKER LLC or used under applicable rights and are protected by applicable intellectual-property laws. Use of a Blue TiefPunkt application does not transfer ownership of Blue TiefPunkt or RMBAKER LLC intellectual property to the user. Third-party trademarks, product names, company names, technologies, file formats, and other intellectual property remain the property of their respective owners. 11. Application Availability and Changes Blue TiefPunkt may modify, update, add, remove, or discontinue application functionality as products evolve. Blue TiefPunkt does not guarantee uninterrupted or error-free operation or permanent compatibility with any particular device, operating system, third-party product, service, hardware configuration, or file format. Software updates, operating-system changes, third-party service changes, hardware changes, or other circumstances outside the control of RMBAKER LLC may affect application functionality. 12. No Professional or Regulatory Advice Blue TiefPunkt applications and associated information do not constitute legal, regulatory, licensing, surveying, navigation, engineering, or other professional advice or certification. Users remain responsible for obtaining appropriate professional guidance when their circumstances require it and for independently verifying requirements applicable to their activities. 13. Disclaimer of Warranties To the fullest extent permitted by applicable law, Blue TiefPunkt applications are provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory. RMBAKER LLC does not warrant that an application will be uninterrupted, error-free, completely secure, compatible with all equipment or data, or suitable for every intended purpose. Nothing in these Terms excludes warranties or other rights that cannot lawfully be excluded. 14. Limitation of Liability To the fullest extent permitted by applicable law, RMBAKER LLC, including through its Blue TiefPunkt brand, will not be liable for indirect, incidental, special, consequential, exemplary, or similar damages arising from or related to use of, inability to use, or reliance upon a Blue TiefPunkt application or its outputs. This includes, without limitation, losses associated with: * Loss, corruption, or alteration of data; * Incorrect or incomplete user-entered information; * Positioning or measurement errors; * Processed, edited, interpreted, or exported data; * Equipment, device, software, network, or third-party service failures; * Incompatibility with third-party products, services, or file formats; * Business interruption or lost opportunities; or * Decisions made by governmental agencies, regulators, customers, employers, professionals, manufacturers, software providers, or other third parties based upon application data or outputs. Nothing in these Terms limits liability where such limitation is prohibited by applicable law. 15. Indemnification To the extent permitted by applicable law, users agree to be responsible for claims, losses, liabilities, or expenses arising from their unlawful use or intentional misuse of a Blue TiefPunkt application, their violation of these Terms, or their violation of the rights of another person or entity. 16. Termination or Restriction of Use RMBAKER LLC may restrict or terminate access to an application or related service where reasonably necessary to address material violations of these Terms or the Acceptable Use Policy, fraud, abuse, security threats, legal requirements, or misuse of application or subscription functionality. 17. Changes to These Terms These Terms may be updated periodically to reflect changes in applications, functionality, business practices, platform requirements, or applicable law. Material revisions will be reflected by updating the Effective Date above. Continued use of an application following the effective date of revised Terms constitutes acceptance of the revised Terms to the extent permitted by applicable law. 18. Governing Law These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-law principles, except where applicable law requires otherwise. 19. Severability If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law. 20.
